The LE PHARM.EU online store is operated by LE PHARM D.O.O., which is also an e-commerce service provider (hereinafter “LE PHARM”).

The General Terms and Conditions determine the activities in LE PHARM online store and define and regulate all rights and obligations of consumers and traders. The consumer is obliged to comply with the General Terms and Conditions in force at the time of purchase (submitting an online order). When ordering, the consumer will be reminded of the General Terms and Conditions to which he agrees by submitting the order.

By using the LE PHARM website, the consumer confirms that he understands, accepts and agrees to all provisions on privacy and use of personal data.

The Merchant reserves the right to change the General Terms and Conditions at any time without prior notice and will not be liable for any possible consequences arising from such changes. These changes take effect upon publication on the LE PHARM website. By using the site after a change in the terms of business, the consumer confirms that he agrees with the changes.

A user is a person who uses the merchant’s website and the online store located on that page.

A consumer is a person who uses a merchant’s website and makes a purchase in an online store operated by LE PHARM D.O.O. on the Le Pharm website.

Website owned by LE PHARM D.O.O. it is intended for the presentation and sale of products.

The General Terms and Conditions determine the activities on the website, define the rights of consumers and regulate the relationship between consumers and traders.

Purchase process:

Cart

In the LE PHARM online store, select the product and click “add to cart”. For products that have several variants for selecting strength, size, taste and / or type, click “select taste / strength / size / type” and select the product and then click “add to cart”.

When you click on “add to cart”, the cart will open / appear on the right side of the screen. To continue shopping, click “continue shopping” and the cart will close; this will allow you to continue shopping in the web store.

To remove a product from the cart, click on the “X” or “remove” or set the product quantity to 0. The cart is updated automatically.

To increase the amount of products already selected in the cart, click on the cart icon and increase the amount of products. You can do this by clicking on “+”. The cart will update automatically.

The shopping cart icon allows you to view selected products and shows you a partial amount of your order (excluding shipping costs).

You can complete your purchase in 3 steps. Clicking on the “shopping cart” icon will take you to the page of selected products. To complete your purchase, click the “Continue” button, where you fill in your personal shipping information. You also choose the method of delivery and payment.

Coupons / promotional codes

Promotional codes or coupons bring a variety of benefits when shopping and are usually limited by time or a minimum order amount. Promotional codes can be found on our website, on social networks, in e-mail notifications and the like.

The promotional code cannot be exchanged for cash and can only be used in full. If the value of the order is greater than the value of the coupon, the customer pays the difference in price. The order amount must be greater than the coupon value.

Use of coupons / promotional codes

Select the product you want to buy and add it to the cart. Select a shipping method, enter shipping information, and select a payment method. Enter the code in the field provided and confirm by clicking on “apply code”.

Once you have entered and applied the discount code, the value of the coupon will be automatically deducted from the order amount. If the order amount is greater than the value of the code, the customer pays the difference.

Payment

To complete the order, click on “order now” and fill in all the fields provided.

The consumer must provide the requested information (name, surname, street, house number, city, postal code, country, e-mail address and telephone number and all other information required for delivery and payment) in order for the order to be executed, processed and delivered.

Method of payment: You can pay for products purchased in the web store in the following ways: by payment on account, payment cards (Mastercard®, Maestro®, Visa, Diners, Discover and cash on delivery. You choose the method of payment during the purchase / order process.

Payment slip: When ordering when choosing payment options, a transfer payment is also offered. You need to enter the data whether it is a natural or legal person and you will receive an offer by e-mail with an invitation to pay. After the payment is made, the shipment is sent by courier service.

Cash on delivery: This is a cash payment upon receipt of the shipment. If you pay in cash, you will pay for your order in the correct amount, once and in cash to the courier employee when picking up the goods. Cash on delivery can only be paid in Croatia. Cash on delivery is made exclusively in cash, ie the amount cannot be paid by credit card.

Card (one-time or in installments): Credit or debit card – this is payment directly via the Internet, using a card payment service. You can choose one-time payment or installment payment.

Coupons: If the consumer has a discount code (coupon), he should enter it in the field provided and click “apply code” to apply the code to the order.

Order overview: The page https://lepharm.eu/cart shows the products that the consumer added to the cart when browsing the online store. The prices of each product separately, the delivery price and the total amount of the order will be displayed before the consumer completes the order.

Completing the order: The user can see the submitted information for delivery and payment, the selected method of payment and method of delivery, and the contents of the cart. The user confirms and submits the order by clicking on “complete the order”.

Purchase Completion Notification

The purchase process for legal entities is the same as for natural persons (the procedure described above), except that when ordering a legal entity they must state the name and OIB of the company / institution. When ordering, when entering the data for payment on behalf of the customer, it is necessary to enter the full name of the company / institution, and enter the OIB of the legal entity in the surname. This way you automatically receive an R1 invoice by e-mail.

Issuing invoices

After paying the invoice for the ordered products, LE PHARM D.O.O. will send the invoice to the customer in electronic form to the e-mail address of the customer and / or in physical form to the delivery address provided by the customer when ordering. The invoice will be included in the packaging together with the ordered products. The invoice consists of personal data of the buyer and merchant, invoice items, total price, VAT and shipping price. The buyer is obliged to check the accuracy of the data before ordering.

Order

Purchase agreement between LE PHARM D.O.O. and the customer is concluded at the moment when the LE PHARM online store sends an e-mail confirming receipt of the order made by the customer. From that point on, all prices and other conditions are unchanged and apply to LE PHARM D.O.O. and the buyer.

The purchase agreement (for example, the first notification of receipt of the order by the customer) is in electronic form on the server LE PHARM and is available to the customer at his written request.

Prices

The prices of products in the online store are the same for registered users and guests in the online store.

All prices include VAT unless explicitly stated otherwise.

Prices are valid at the time of order and do not have a pre-set validity.

Prices are valid for payments made in the following ways according to the conditions and the purchase process.

Despite the merchant’s efforts to keep prices up to date and accurate, price information may be inaccurate. In this case or in case the price of the product changes during the ordering process, the trader will allow the buyer to cancel the order and at the same time the trader will offer the buyer a solution that will satisfy both parties.

Delivery

LE PHARM D.O.O. will deliver the ordered goods following the business conditions of the Croatian Post and the GLS and DHL delivery services. When creating an order, the buyer is obliged to provide a complete and accurate delivery address. LE PHARM D.O.O. will inform the customer of the right to cancel the purchase and will provide all necessary information related to the address to which the customer can send a complaint in case of complaints and reclamations.

If the customer (recipient) is not at the address at the time of delivery, it is possible to pick up the package in accordance with the terms of business of Croatian Post, GLS or DHL. LE PHARM D.O.O. will forward to the Croatian Post or the selected delivery service information for contacting the customer.

The trader reserves all rights to choose another delivery service in the event that it can make the delivery more efficiently.

Delivery times depend on the location of delivery.

Approximate delivery times are:

  • Croatia: 1 – 3 days (Zagreb – 24 hours)
  • other EU countries: 3 – 7 days
  • world: 7 – 21 days

Delivery time also depends on the shipping method you choose when ordering.

We deliver products to the territory of the Republic of Croatia within 3 working days (Saturday, Sunday and non-working days excluded), and to the customer at an address within the European Union within 7 working days (Saturday, Sunday and non-working days excluded) and outside the European Union within up to 21 working days (Saturday, Sunday and non-working days excluded) from the conclusion of the sales contract, if we have the product in stock. If we do not have the product in stock at the time of concluding the sales contract, the previously stated delivery deadlines do not apply. In the event that for any reason we are unable to deliver any of the ordered products, the customer will be contacted, by phone or e-mail, by an employee of Le Pharm d.o.o. for the purpose of agreeing on the delivery of a replacement product or possible cancellation of the ordered product.

Shipping costs

Packaging and delivery costs depend on the location of delivery, the quantity of the product and the total price of the order. The delivery services we use for delivery are the Post Office of Croatia, GLS and DHL.

The delivery price depends on the shipping method you choose when ordering.

  • urgent sending Croatia – 49.90 kn
  • international shipment to an EU country 59.90 kn
  • other countries outside the EU 89.90 kn

Responsibility

LE PHARM D.O.O. is liable for material defects of the product until the moment of transfer of risk to the buyer (the moment of handing over the things to the buyer or a third party designated by the buyer, who is not the carrier), regardless of whether he was aware of the material defect. It is also liable for those material defects that occur after the transfer of risk to the customer if they are the result of a cause that existed before.

The consumer is obliged to inform the seller of the existence of visible defects within 14 days from the date of receipt of the product.

LE PHARM D.O.O. will resolve complaints as soon as possible, and we resolve all complaints in accordance with the provisions of the Consumer Protection Act.

If the existence of a material defect is determined, the seller may have one of the following obligations, all in accordance with the provisions of the Civil Obligations Act:

  1. elimination of the defect,
  2. delivery of another product without defect,
  3. price reduction,
  4. contract termination.

Rights based on material lack of property are regulated by the Law on Obligations.

When the buyer is a legal entity, the rules on material defect prescribed by the Civil Obligations Act apply to him, especially in the part where the material defect for legal entities is regulated differently than stated in the Terms of Use, then the Civil Obligations Act applies.

Security

LE PHARM D.O.O. uses appropriate technologies and organizations for the purpose of protecting and storing personal and payment data.

Secure authorizations and credit card transactions are managed by CorvusPay.

Credit card authorizations are performed in real time with instant data verification by banks. Card information is not stored on the server LE PHARM D.O.O.

Protection of personal data

The right to cancel the order and terminate the contract

Pursuant to Article 72, paragraph 1 of the Consumer Protection Act (NN 41/2014), the consumer has the right, without giving reasons, to unilaterally terminate a contract concluded outside business premises or concluded remotely within 14 days of receipt of the product.

In order for the consumer to receive a response to the complaint in accordance with Article 10, paragraph 5 of the Consumer Protection Act within 15 days from the date of receipt of the complaint, the consumer must provide accurate information for the receipt of the same.

The consumer must return the goods without delay, and no later than 14 days from when, in accordance with Article 74 of the Consumer Protection Act (NN 41/2014), he informed the trader of his decision to terminate the contract.

The consumer is obliged to return the products to the address: Le Pharm d.o.o., Gradina 5, 52449 Červar Porat, Croatia.

The consumer is obliged to return the products to the trader undamaged and in the same quantity, unless the product is destroyed, damaged, lost or its quantity is reduced through no fault of the consumer. The product must be returned undamaged and unused, in the original factory packaging.

The consumer is obliged to bear all direct costs of product return. The consumer is responsible for any impairment of the goods resulting from the handling of the goods, other than that which was necessary to determine the nature, characteristics and functionality of the product.

When the consumer terminates the contract, he is obliged to send the invoice he received when ordering, personal data and transaction account data to which the merchant will make a refund. The trader shall, within 14 days of receiving notification of the consumer’s decision to terminate the contract in accordance with Article 74 of the Consumer Protection Act (NN 41/2014), return to the consumer everything the consumer has paid under the contract.

Upon cancellation of an order, where a discount with a promotional code has been used, these funds are considered a discount and are not returned to the user. Only the amount paid will be refunded to the user’s bank account.

LE PHARM makes every effort to fulfill its duty to establish an effective complaint handling system and to designate a person with whom the customer can contact by phone or email in the event of a problem.

The appeal procedure is confidential. LE PHARM will acknowledge receipt of the complaint within five working days and will notify the customer of the processing period and the progress of the procedure.

LE PHARM is aware that an essential feature of a consumer dispute, at least as far as judicial resolution is concerned, is the disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also the main obstacle for the consumer not to initiate a lawsuit. Therefore, LE PHARM strives best to resolve all disputes amicably.

In the event of a dispute, LE PHARM d.o.o. and the consumer will resolve the dispute amicably, and if this is not possible, the court with real and territorial jurisdiction shall have jurisdiction with the application of Croatian law.

Alternative Consumer Dispute Resolution

As of February 15, 2016, you have the right and opportunity to resolve disputes related to online shopping throughout the European Union in just a few clicks on this site.
